Welcome to the Louise Damas online store. By making a purchase on our platform, you automatically accept our terms and conditions of sale. Therefore, we recommend that you carefully read the information below before making a purchase with us.

The company

The present general terms and conditions of sale are concluded between SAS LD Designs, registered under the SIRET number 83341183800034, hereinafter referred to as the "seller," and any individual or entity wishing to make a purchase via the website louisedamas.fr, hereinafter referred to as the "buyer."

The acquisition of a product via the site louisedamas.fr implies the buyer's unconditional acceptance of these terms and conditions. These terms and conditions will prevail over any other general or specific conditions not expressly agreed to by the seller.

The seller reserves the right to modify its terms and conditions at any time. In such cases, the applicable conditions will be those in effect at the time of the buyer's order.

Characteristics of the products offered

The descriptions and photographs of the items sold on the Louise Damas website are as accurate and true to reality as possible. However, as the jewelry is handmade, some of the indicated lengths may have slight variations. Similarly, certain colors and shapes may show irregularities inherent to their natural character or to the artisanal manufacturing process.

The customer acknowledges that the photographs, descriptions, or graphics accompanying and illustrating the products offered for sale on the site are for informational purposes only and are non-contractual, and the seller shall not be held responsible in the event of an error, omission, or modification.

Louise Damas jewelry is guaranteed for life against manufacturing defects, provided it is used correctly and the care instructions are followed. During this warranty, depending on our assessment and the availability of parts, the jewelry may be repaired.

The warranty does not cover jewelry that has been subject to improper use or treatment, failure to follow care instructions, any external intervention resulting in a modification or alteration of the original design, or an accident.

Except in the case of a verified manufacturing defect, only the shipping costs will be charged to the customer.

Beyond the warranty conditions, Louise Damas offers a re-gilding service for all of its jewelry (free for one year from the purchase date). After the first year, this service is available upon request, for a fee, depending on the surface area of the piece to be re-gilded. The re-gilding will be carried out after payment of the fees. We reserve the right to refuse jewelry showing signs of wear that go beyond the loss of gilding.

The repair and re-gilding process takes 4 to 8 weeks from the receipt of the jewelry in our workshop. However, the timeline may vary depending on the workshop's activity.

Prices

The prices listed on the louisedamas.fr website are inclusive of VAT in euros. They do not include shipping fees, which are charged in addition to the price of the purchased items. Shipping fees will be indicated before the buyer confirms the order.

The seller reserves the right to modify prices at any time. However, they commit to charging for the goods ordered at the price shown when the order is placed.

Orders

The information provided by the buyer when placing an order is binding.

In the event of an error in the recipient’s address details, the seller cannot be held responsible for the inability to deliver the product.

Orders are only considered final once payment has been confirmed by the buyer.

Any parcel that cannot be delivered and is returned to the sender will be re-shipped at the customer’s expense.

Once the order is confirmed, the recipient agrees to cover any customs duties and taxes related to receiving the package.

If the recipient refuses to pay customs duties, the sender will not be able to retrieve the package for a refund of the order.

Withdrawal and Returns

Return requests must be made online through our platform.

In accordance with Article L.121-20-12 of the French Consumer Code, the buyer has a period of fourteen days to return, at their own expense, any items that do not suit them for a refund. This period starts from the day the order is received.

All returns must be notified in advance by email to: bonjour@louisedamas.fr. This right of withdrawal is exercised without penalty, except for shipping and return costs.

The returned item(s) must be in new condition, unworn, unused, and in their original packaging. Otherwise, the products will not be refunded or accepted for return.

Please note that the right of withdrawal does not apply to personalized purchases (such as engravings), which involve an aesthetic modification of the original jewelry.

Exchanges for online orders are not available either on the website or in-store.

Payment

The buyer makes their payment via Payplug, which allows for secure credit card transactions.

Delivery

Depending on the shipping method selected by the customer on the website, orders will be shipped as follows:

Within France: via Colissimo (1 to 5 business days) or UPS (1 to 3 business days).

Internationally: via UPS (2 to 7 business days).

The delivery times indicated on the website and in the order confirmation are for reference only and correspond to the average processing and shipping times. These times do not apply to pre-order items or personalized products. Additionally, they do not account for potential disruptions experienced by carriers.

Any reasonable delay in shipping the products shall not entitle the buyer to compensation or the cancellation of the order.

If the package is damaged upon delivery, the customer must check the condition of the items in their order with the carrier and note any missing or damaged items on the carrier’s delivery slip.

Liabilities

The seller's liability cannot be invoked if the non-performance or delay in executing any of its obligations under these general terms and conditions results from a force majeure event.

In this context, force majeure refers to any external, unforeseeable, and unavoidable event as defined by Article 1148 of the French Civil Code.

Additionally, the seller cannot be held liable in the event of disruptions or total or partial strikes affecting postal services.

Intellectual Property

All elements of the site louisedamas.fr are and remain the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, redistribute, or use any part of the site, even partially, for any purpose.

Archiving / Proof

The seller will archive the order receipts on a reliable and durable medium, constituting a true copy in accordance with the provisions of Article 1348 of the French Civil Code.

The seller's computerized records will be considered by both parties as proof of communications, orders, payments, and transactions that occurred between the seller and the buyer.
